Applicable for the interaction with Baesties ("I", "we", "us", "our", "Service", "App") in any form (e.g. visiting baesties.com, communication via mail, using our mobile app etc.):

 

1. INTELLECTUAL PROPERTY

Unless otherwise stated, texts, images, databases, features, source code, design, audio, video, graphics, and software ("Content") of the Website and the App are the intellectual property of us. The Content is provided "As-Is." We do not guarantee that the service will function at all times flawlessly and will be provided without errors. The Content may not be used without express consent from third parties unless it is positive recommendations/advertisements for us (e.g., newspapers, social media posts).

2. SCOPE OF APPLICATION

Our General Terms and Conditions ("Terms") apply to all interactions between the user and us.

3. CONCLUSION OF THE CONTRACT

The contract between the customer and us is concluded when the customer registers in our app. The use of our app is free of charge.

4. CANCELLATION POLICY

a) Right of withdrawal: You have the right to delete your account at any time and to request the deletion of your data from us.

 

b) Consequences of the revocation: Once your account has been deleted, there is no way to reactivate it. If you decide to use our app again in the future, you will need to create a new account. Your username is also freely available again after your deletion, which means that your username may have been taken over by another user.

5. CONTRACT LANGUAGE

The contractual and business language is English.

6. COSTS

Our app is free to use. Note that their might be In-App-Purchases in the future.

7. OWNERSHIP OF DATA

By using our services, we are the owner of the data you have provided. This means that we may use your data in any form, including for analysis purposes, as long as it does not violate national law. However, you have the right to request the deletion of your data at any time.

8. ALTERNATIVE DISPUTE SOLUTION

We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

9. DATA PROTECTION

Data protection is very important to us. We strictly adhere to the provisions of the Data Protection Act in the use and processing of your data. Your data necessary for the usage of our service will be stored on secure servers. We hash sensitive data, such as your login data.

12. RIGHT TO INFORMATION, CORRECTION, BLOCKING, AND DELETION OF STORED DATA

You have the right to free information, correction, blocking and deletion of your stored data at any time. You can contact us in this matter in writing by e-mail at ([email protected]) or by post to the company location indicated in the imprint. This right is only limited to the extent that we can suspend the deletion to protect our claims.

13. APPLICABLE LAW

For all legal transactions, the application of Austrian law is agreed to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

14. JURISDICTION

If a customer is a consumer in the sense of the KSchG, the court in whose district the customer's domicile, habitual residence, or place of employment is located shall have jurisdiction for any legal disputes. In all other cases, the competent court at the company's location is agreed as the place of jurisdiction.
